DISTANCE SELLING AGREEMENT

(Within the scope of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts)

ARTICLE 1 – PARTIES

The SELLER and BUYER will hereinafter be referred to jointly as "Parties".

ARTICLE 2 – SUBJECT OF THE AGREEMENT

This Distance Selling Agreement ("Agreement") has been prepared within the framework of the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, regarding the sale of fans and related accessories carried out through the SELLER's website. The Agreement is deemed accepted by the BUYER upon completion of the order.

ARTICLE 3 – PRODUCT INFORMATION AND PRICE

3.1. The type, quantity, color, and price of the product(s) subject to the Agreement are included on the order summary page and in the order confirmation email sent to the BUYER.

3.2. Since the products may be handmade/custom-made, color and pattern tones may differ slightly from the visual.

3.3. All prices include VAT. Shipping fee is stated separately.

3.4. The SELLER reserves the right to cancel the order due to stock availability or price changes; in this case, the BUYER will be informed immediately and the payment will be refunded.

ARTICLE 4 – PAYMENT TERMS

4.1. Payment is made in advance during the order process using a credit card, debit card, or other provided payment methods.

4.2. All payments are secured with 256-bit SSL encryption.

4.3. In installment transactions, the interest and fees applied by the bank are the responsibility of the BUYER.

ARTICLE 5 – DELIVERY TERMS

5.1. Products are shipped within 1-5 business days after payment confirmation. Delivery time varies between 1-4 business days depending on the shipping company and the BUYER's location.

5.2. The maximum legal delivery period is 30 calendar days from the order date. If this period is exceeded, the BUYER may terminate the contract.

5.3. The product is delivered to the address provided by the BUYER in the order form. The responsibility for incorrect address notification belongs to the BUYER.

5.4. If a damaged product is received during delivery, the BUYER may refuse to accept the product by drawing up a report with the cargo officer.

ARTICLE 6 – RIGHT OF WITHDRAWAL

6.1. The BUYER has the right to withdraw from the contract within 3 (fourteen) calendar days from the date of receiving the product, without showing any reason and without paying any penalty.

6.2. The BUYER can make the withdrawal notification by sending an email to infosoreya@gmail.com or through the contact form on the website.

6.3. When exercising the right of withdrawal, the product must be returned in its original packaging, unused and undamaged.

6.4. The return shipping cost is borne by the BUYER.

6.5. The SELLER will refund the payment within 14 days after receiving the product.

6.6. The right of withdrawal cannot be exercised in the following cases: (a) Products manufactured specifically for the individual; (b) Products prepared at the BUYER's request or clearly for their personal needs; (c) Products whose seal or packaging has been opened and are not suitable for return.

ARTICLE 7 – RETURN AND EXCHANGE

7.1. In case of delivery of a faulty, incomplete or damaged product, the BUYER may notify the SELLER within 3 (three) days from the date of receiving the product.

7.2. In these cases, one of the options of free exchange, repair, price reduction or full refund will be offered at the BUYER's request.

7.3. The shipping cost for exchange or return in case of faulty delivery is covered by the SELLER.

ARTICLE 8 – PRIVACY AND PERSONAL DATA

8.1. The BUYER's personal data is protected under the Personal Data Protection Law (KVKK) No. 6698.

8.2. Data is used only for processing and delivering the order; it is not shared with third parties without explicit consent.

ARTICLE 9 – DISPUTE RESOLUTION AND AUTHORIZED COURT

9.1. In disputes arising from this contract, Consumer Arbitration Committees are authorized within the monetary limits determined annually by the Ministry of Industry and Trade, and Consumer Courts are authorized for disputes exceeding these limits.

9.2. The authorized courts and enforcement offices are those in Istanbul, where the SELLER is located, and those in the BUYER's place of residence.

ARTICLE 10 – EFFECTIVENESS

This Agreement, consisting of 10 (ten) articles, comes into force mutually upon the BUYER's approval of the order. The BUYER declares that they have read, understood, and accepted the agreement before placing an order.
